Conflicto de competencia suscitado entre el Juzgado Segundo Administrativo Oral del Circuito Judicial de Duitama (Boyacá), el Tribunal Superior del Distrito Judicial de Santa Rosa de Viterbo (Boyacá) y el Juzgado Tercero Civil Municipal de Sogamoso (Boyacá).
Encontró la Corte que en el presente caso sólo se presentó un conflicto aparente, en la medida en que las dos primeras autoridades se negaron a continuar con el conocimiento de la solicitud de amparo con fundamento en reglas de reparto.
Se dirimió el asunto con la remisión del expediente al Juzgado Segundo Administrativo Oral del Circuito Judicial de Duitama para que, de manera inmediata, tramite y adopte la decisión que corresponda.
A los dos operadores jurídicos mencionados se les hizo una advertencia para que, en adelante, se abstengan de declarar su falta de competencia con base en reglas de reparto en materia de tutela.

- Segundo. Administrativo Oral del Circuito Judicial de Duitama, Boyacá, dentro del trámite de la acción de tutela presentada por el señor Fredy Yesid Alvarado Martínez contra la Inspección Tercera Municipal de Policía de Duitama, la Alcaldía Municipal de Duitama y la Procuraduría Provincial de Santa Rosa de Viterbo.
- SEGUNDO. REMITIR el expediente ICC-4701 al Juzgado
- Segundo. Administrativo Oral del Circuito Judicial de Duitama, Boyacá, para que, de manera inmediata, tramite y adopte la decisión que corresponda respecto de la acción de tutela presentada por el señor Fredy Yesid Alvarado Martínez contra la Inspección Tercera Municipal de Policía de Duitama, la Alcaldía Municipal de Duitama y la Procuraduría Provincial de Santa Rosa de Viterbo.
- TERCERO. ADVERTIR al Juzgado
